Legal Question in Landlord & Tenant Law in California

Eviction

I have a 1 year lease and my landlord has asked me to move (served no paperwork) due to this months rent being 11 days late. Is this legal?

Re: Eviction

You have not told us whether you are in a rent controlled city or not and when the lease expires. It sounds like his is trying to give you a thirty day notice without giving you one. But unless you quickly pay the rent that is due or make some arrangements with him, he will next serve you with a valid three day and thirty day notice. If there is a reason for being late, talk to him, otherwise still talk to him but arrange terms of moving out so it does not hurt your credit or references for future housing.

Re: Eviction

Your landlord has to serve you with a 3-day notice to pay or quit. If you pay within those 3 days, then you can stay (as long as you pay next month's rent on time).

Re: Eviction

My learned colleagues have already covered the answer, since your question is unclear as to whether you received a 3 day notice, or he just verbally asked you to leave.

Either way, follow the advice given.
