Legal Question in Landlord & Tenant Law in California
Fire in rented home
We had to move because of fire in the home.
The Fire Chief said I should have a inspection done by an electrician to determine that the wiring had been done to code and permits had been issued . His point was it is a 70 year old house and someone has done wire splicing at the spot the fire started. He seem to be telling me there were signs that someone had done some mickey mouse wireing over the years, My question, does my landlord have any responsibility to me for my uninsured loss? My loss is less than $3000. in personal property

Re: Fire in rented home
Maybe - if you can prove that the fire was caused by the homeowner's shoddy wiring, then you can probably sue him in small claims court and prevail. See if the Fire Chief will come to court and testify that he thinks the wiring started the fire - if so, that's pretty strong evidence to support your claim. Otherwise, you will need a forensic investigator - not an electrician - to prove in court that the wiring caused the fire. An electrician can testify that the wiring was faulty, but is not qualified to render an opinion that the faulty wiring caused the fire. Sorry to hear of your loss, and good luck with this.
