insects

my apartment in los angeles california is full of oriental cockraoches the landlord has sent someone to spray twice but my apartment is still overrun with them.

What are my rights until the problem is corrected? I can not stay there in the apartment, it is not healthy

You have a number of rights. I am going to answer very briefly, and, if you need more, don't hesitate to e-mail, or call, my office.

First, call the local building inspectors and the Board of Health. Ask them to send an inspector ASAP.

Next write your landlord (LL) a certified letter, return receipt requested. Send a separate copy by regular 41 cent mail . (lots of time, people refuse to sign for certified letters). Tell LL, this as an emergency, and you expect an exterminator to eliminate the roaches within 3 days, or you will either withhold rent, repair and deduct, or vacate the premises. Tell LL you have also reported this to the building and health departments.

If you have a camera, take pictures of your "visitors", maybe a dozen pictures, or so. If you do not have a camera, you can buy one for $5 or $6 at Long's, Walgreen's, Walmart, etc. that is disposable and has one roll of film in it.

Make sure you have the inspectors send you written reports.

The above may take care of your problems. As I said above, it is rather long and complicated, so e-mail, or call, my office if you need more.
