Legal Question in Landlord & Tenant Law in California

Landlord Refuses to Tell Me Who He Has Homeowner's Insurance With

I have been living in the same residence (I'm a renter) for more than 11 years, in Vallejo, California. A few days ago, the house that I was renting burned down, with me and my 3 grandchildren inside of it. All of us made it out okay. The Fire Marshall's report states that the fire was due to an electrical shortage, which the landlord had been notified of, and failed to fix it. The electrician's report also stated the time and dates that he came out and spoke with the landlord. I asked the landlord what was the name of his homeowner's insurance; however, he refused to give it to me. Instead, he had my neighbor get in contact with me, stating that he would return my $50 deposit from 11 years ago. I am now homeless with my 3 grandchildren, and I don't know what to do. All of my belongings are burned except the clothes that are on our backs. Can someone please help me.

It doesn't matter who is insurance company is and whether he turns the information over to you. You need to file a lawsuit and get him served. He will then turn it over to his insurance company.

Contact an attorney in your area.

Your landlord appears to have been negligent in his wilfull disregard of the electrical problem. You were damaged as a result of that negligence. Thus, it appears to me that you have a decent case. I'm in the East Bay and would be happy to talk to you further.

You need help from a lawyer ASAP.

I suggest you follow Mr. Meyer's advice, since he is only a few miles away (well, a few miles and 45 minutes worth of rush hour traffic).

If you need more from me, please e-mail me, but I'd make an appointment with Mr. Meyer as soon as you can.
