what are my rights if i am 5 days late on our rent and got a 3 day pay or quit letter and they wont accept any payments after the three days and we have to move?

Your landlord does not have to accept your rent if you tried to pay them more than more than three days after you were served with a 3 day notice to pay or quit.

Their next move is to file an unlawful detainer, which seems silly if you have the money, were not habitually late in your rent and your rent is at market rate.
