Legal Question in Landlord & Tenant Law in California

Tenant Law

Does my landlord have to provide written notice of termination of a month-to-month lease? He left a message on my answering machine that I have to leave in 30 days because he has rented to someone else.

Re: Tenant Law

Yes, even month to month tenancies require proper legal notice in writing, unless the parties waive this requirement in the lease agreement itself per se. Your lease agreement will dictate how notice must be served, and your landlord must follow these procedures or cannot lawfully "evict" you. You may want to retain legal counsel ASAP to best protect your rights here before its too late.
