Legal Question in Landlord & Tenant Law in California

Unfair possible eviction

I have until the 3rd to pay, until the

6th w/late fee. I had my rent on the

8th and they wouldn't take. The

building mgr. said they already

started the eviction papers at the

office but that she didn't think they

had gone to the lawyer yet. Then

she said that it cost the office $195

just to draw up the papers and that I

would have that fee this month too.

I told her that I didn't have that

money and she said maybe she could

convince them to have me work it

off and take photos of their other

properties as I am a freeelance

photographer. Then, she also said

that if they let me stay my rent

would probably go up to the full

market value which is $650. Plus,

now even more time has gone by

with my rent not turned in.

Re: Unfair possible eviction

Bad news. You are late, and landlord (or agent) can begin eviction. They do not have to take the rent. The sum of $195 is not exorbitant for paper work for an eviction service, and cheap for an attorney. I don't know what your rent has been, nor what full market value is, but you need to try to negotiate, or find a new place. More bad news...if they do file an unlawful detainer, it will be on your credit report, and you probably will not be able to rent again without a co-signor.
