Legal Question in Legal Ethics in California

Banks: unsafe sensitive information

I received in the mail a notice by my personal bank about a transaction they made by mistake. The notice has all my personal info like name, home address and of course, account number. My concern is that the envelope was open. The glue section of the envelope is intact; you can tell it was never sealed to begin with. With all the identity theft that's happening right now, I want to know if there's a legal action I can take against the bank for their lack of responsibility in protecting sensitive information.

Thank you.

Re: Banks: unsafe sensitive information

As to any legal action, what are your damages? They would likely take the loss of your business far more seriously than a lawsuit.

Re: Banks: unsafe sensitive information

Our system of laws is predicated much more on damage suffered, than the potential of damages.

I don't see where you have a cause for an action.

I would mention this to the branch manager, and see if they care enough about your business to "reward" you in some way.

You are welcome!

Write to them about this issue. Also, check your credit report to make sure there's no problem.
