Legal Question in Legal Ethics in California
My business has been struggling, and we have not yet completed a large project (race vehicle) for a customer. The customer paid in full at the start of the project, which has now been almost 3 years ago. I believe he is going to sue me, but I'm not sure what action he can take. We have been working on the project, but it has been very slow, and only because I have no funding to complete it. What could he go after me for, and what can I possibly do to protect myself? I have full intention of completing the project, but it's going to take more time due to my financial constraints.

Your customer and you had certain expectations, when you started the project. These expectations included terms such as funding, completion dates, and the nature of the vehicle. I have represented people in your business, and I understand that large projects get put on the back burner, now and then, when funding gets low. I think you need to sit down with your customer and see if you can come up with an agreement for a definite course. Set deadlines, goals, and clear up expectations. You might also need to get a loan to finish the work, since the customer paid in full.
