Legal Question in Legal Malpractice in California

Malpractice

My wife is a dyalisis patient. She went to a vein center in Downey, Ca called Downey medical center. They tried to unclog here vein. When they did this, here arm was so swoolen she couldnt move it. I have pictures of it. Then to top it off they had put the wrong size cathetor on. She then needed to go through another surgery to replace the cathertor she had on. They (Davita on Washington Bl in LA) expected her to go to the same place. We ended up going to Saint vincent hospital. They did pressure us to go back, but we did not. This was a living nightmare and now my wife is very depressed. please advise

If you are thinking you have a 'medical malpractice' action, then before you can file the case you MUST have a medical expert prepared to give his opinion and testimony that there was malpractice. Your opinion, and mine, do not count. Where she went for subsequent treatment is the starting point for you to ask the doctors what they think of the initial procedure. You may reasonably expect to have trouble finding a doctor willing to give such opinion and testimony. You may have to seek out a medical 'expert witness' willing to review the charts and testify.
