Birth injuries to babies from medical malpractice in California have a statute of limitations that is generally eight years so the 1 year parameter should not be a problem. It is not possible to state whether this is or is not a case of negligence with only this information and one would need to know the current condition of the child along with the circumstances of the fractures. First, see if your baby's current doctor is willing to give you a 'medical opinion' that the problem was caused by the original doctor or not. If he won't give you a favorable opinion, then seek out another doctor if you still believe there was negligence. You can NOT file a malpractice lawsuit without such opinion stating there was negligence and fault by the doctor. Feel free to contact me when you are ready to get help in this.
