Legal Question in Medical Malpractice in California

birth injury to baby

My daughter is 12 yrs. old, she has

severe scoliosis that we did not know

of until last year, she might need

surgery to correct. She had a very

intense delivery as a baby. The nurse

midwife at the hospital, had to

suction her out with a machine

whare they twisted and pulled her

out. There was no visible sign of any

back trauma at the time, however

now she has a 45% curvature of the

spine. Is there any possibility of a

law suit?

You could sue, but I doubt you can win.
