Legal Question in Medical Malpractice in California
C-diff Malpractice? Prescription injury?
Hi,
My long time friend was given clindamycin by her dentist two years ago as a pre-antibiotic treatment before having work done on her teeth. Shortly after she became very ill and nearly lost her life twice within one months time before being diagnosed with Clostridium difficile (C-diff). Last year she had eighteen inches of her intestine removed which helped for a while but she has suffered another relapse just recently and is very ill. There is also a possibility that her doctor may have puntured her colon while performing one of several colonoscopies she has had done. She has not been able to work for a couple of years now and her friends and family feel helpless and scared watching this once healthy and vibrant 54 year old slowly wither away. This is a complicated situation and I believe she needs to talk to a lawyer. What are her options? Thanks in advance for any info you can give us.

Re: C-diff Malpractice? Prescription injury?
For starters, she needs to understand that she has only one year from discovery and knowledge of malpractice to bring her suit. If that time has gone, so is her claim. If she could still be timely, then she has to find a doctor willing to testify that what happened to her was malpractice; she can't file suit until she gets that. She may contact me to discuss the facts and her rights and remedies, and get guidance on what she needs.
