Legal Question in Medical Malpractice in California

Failed surgery-medical malpractice?

I had a double disc fusion surgery plating using alograft of c5-c7. I had 3 confirmed surgeons oppinions + mri--name removed---name removed--etc. I was in more pain following the surgery and complained continously. The doctor saw me 2x, I was otherwise seen by his nurse practitioner. I insisted on speaking with the doctor and when he saw me he said, '' I am going to have to do another surgery. '', '' I will go in, undo what I did, flip you over and go in the other side. I got really scared and switched back to my previous doctor/neurologist. I have been admitted to the hospital 2x. Test--name removed--were performed including another mri and found out I have another herniated disc. I am unsure what I can do. The surgery was July 29, 2005 - I had the newest mri during my last hospital stay June 2006 when I learned of the 3rd herniated disc. Do I have any recourse?

Please help!

Re: Failed surgery-medical malpractice?

You haven't said a word indicating malpractice. Just because you have pain or problems does not mean you have a case. IF you consult with other doctors and obtain from one of them an opinion that the surgery or treatment was negligently performed and therefore malpractice, then you have a potential case. You must have such opinion before you can file suit. Feel free to contact me if you have, or can get such opinion, or need referral to doctors to consult with. I'll be happy to help you if you actually have a case.
