Legal Question in Medical Malpractice in California

Hospital Surgical Staff left medical instrument in me, what are my options?

I underwent an outpatient procedure, diagnostic laporoscopy which confirmed a diagnosis of an incurable female disease. My doctor basically rented the surgery room and the rest of the surgical staff were employees of the hospital. An ''acorn valve'' (instrument left in me) was one of two ''faulty'' valves. The first one was bent, second which was also ben, he straightened out himself and then inserted it. At the end of the procedure he specifically asked the surgical nurse, twice, if all was accounted for to which she replied yes. Two days later after suffering bad cramps this ''acorn valve'' was emitted from my vagina. The emotional trauma inflicted upon me not just because of this thing being left inside my body but hospital's apparent lack of concern with this matter. Two weeks later I received a letter from the corporate office in Pennsylvania stating it was an ''alleged'' incident and they decline responsibility or liability. Bottom line I still have this thing in my possession, I was willing to accept the refund of the money I paid towards the surgery, since I do not have medical insurance.
