my husband was in the hospital 17 years ago they say he past away from acute morphine intoxication is that the hospitals fault

Without being flippant, it no longer legally matters since the statute of limitations was one year to bring any claim. Even if it was yesterday, no opinion could possibly be given without a full review of the medical records and history.
