Legal Question in Medical Malpractice in California

Kaiser failed to treat advanced gallstones...

My brother who is 42 years old, had gallstone attacks for about 2 years, he had been to a kaiser emergency room at least 3 times or more. 2 months ago, he was taken again to a kaiser hospital from work in ambulance with another attack, he was released and the attending physician believed he was having heartburn, NO ct scan or x-rays were given. I picked him up from the hospital and on the way back to work he had another attack which i had to pull over so he could vomit, he insisted on going back to work though because he had alot of debt. 3 weeks ago my brother presented again at a kaiser hospital this time he had severe pancreatitis and could not be operated on due to inflammation and infection, he was in icu, then put in tcu, my family noticed his breathing was labored and none of us though he looked good at all. about 3 days being in tcu, his heart stopped, he was given cpr, we have heard different stories from the dr's about why his heart stoppped, first it was aspiration, next it was he stopped breathing, third it was he just had a heart attack. Now my brother is in a coma and near death in the icu unit. I know kaiser has arbitration but is this something worth suing kaiser for?

You're asking if there was medical negligence. The only important answer will only come from a doctor who has reviewed the facts and charts, and is willing to testify that it was. However, it certainly sounds like poor diagnosis and treatment, to ignore past attacks, and assume only 'heartburn'.
