Legal Question in Medical Malpractice in California

Lack of care led to loss of hamstring/ work

I am a 31-year-old paraplegic woman. I live on my own, work, and am independent in all my care. I was in a hospital and given drugs (Ativan and possibly something else) that made me like a zombie. Because of these drugs, I sat around all day and was remiss in doing ''pressure releases'' to prevent pressure sores. The condition of my skin was never checked on or asked about by the nurses or staff. Everyone in the healthcare field knows that pressure sores are a risk for wheelchair users. I developed a pressure sore that was not noticed until I was out of the hospital and finally able to properly bathe. That sore was perfect breeding ground for a flesh-eating bacteria that destroyed 5 1/2 inches of flesh in my buttock, resulted in 4 months in/out of hospitals, 5 months away from work and one entire hamstring was removed to fill in the area where the bacteria had eaten my flesh. I almost died from the illness in my body.

I was admitted into the hospital because it was decided I couldn't take care of myself, then SOMEONE SHOULD HAVE BEEN TAKING CARE OF ME, right? The hospital was supposed to be taking care of me when I was deemed unable to (5150) and they failed and caused more and permanent damage.

Re: Lack of care led to loss of hamstring/ work

For starters, if it is more than a year ago from hospital release and discovery of the problem caused by their alleged failure, you are probably past the statute of limitations. If not, you are close to running out of time.

Next, you will have to have a medical expert willing to provide testimony that the standard of care in the hospital was not met, and that your injury is directly caused by their failure. With all that, if you are still timely, and if you have a doctor willing to so state, then contact me to discuss the facts.
