Legal Question in Medical Malpractice in California

Is a late diagnosis of craniosynotosis, a defect of the skull that you are born with, causing the child to have a malformed head and now will undergo major surgery,malpractice on part of his pediatrician who never diagnosed the problem? The doctor was asked on multiple occasions about the childs head and doctor brushed it off after a year of walk around I had to force doctor to refer me.

First, how is it the fault of the doctor that the condition exists??

Next, how is the doctor's conduct or lack of action causing any damage that could have been prevented??

Next, was this condition NOT apparent and obvious, such that you weren't aware early and could have sought other medical care or opinion but for his failure to diagnose?

If and when you can answer at least the last two showing fault on the part of the doctor, then you can consider a malpractice claim.
