Legal Question in Medical Malpractice in California

Painless Periodontal Pete (PPP) is your local dentist. PPP is to perform your gum surgery at the local hospital. You are to receive a general anesthetic. The Anesthesiologist runs out of the necessary drugs during the surgery and you are only 50% under the influence of the anesthetic. At this point the dentist states ''I have a tight time schedule and I'm going to proceed anyway''. You suffer great pain and later need corrective surgery at a cost of $15,000 to restore your mouth. Also as a result your mouth is partially paralyzed permanently. Request to know the liability of PPP, the Anesthesiologist, and the hospital.

If this incident occurred in California, and your claim proves viable there are several things which need to be done to perfect a claim . . . you cannot simply "file a lawsuit" . . . medical malpractice requires special time notice to the offending provider . . . it is also very wise to obtain an opinion from an expert in the field to assure that there is a breach of the standard of care in the community . . . you need to consult with an attorney promptly to preserve your rights of recovery . . .
