Legal Question in Medical Malpractice in California
Medical Equipment Left Behind
Two weeks ago I had lower jaw surgery and during my post-op xray I noticed ''something'' left behind. It turns out is is probably the drill bit used to attach the plates and screws. The doctor has offered to remove it at a later date, only after they said it would be OK there forever and I inisted it would be removed. Do I have a case for malpractice? If so, do I have a right to compensation for pain and suffering?

You may, if the doctor's actions fell below the required standard of care, and you otherwise meet the requirements for a malpractice case. What you do now, whether you try to handle this yourself, or obtain an attorney, may make a huge difference, or all the difference. You may call me to discuss.

You need to find a medical malpractice attorney, as Mr. Bakondi points out.
