Legal Question in Medical Malpractice in California

had an operation without it need

i went to the hospital cause of stomach pain and had my gal bladder removed and when i was out in recovery the surgen told me it was good and didnt needed to be removed

Sounds like you may have a malpractice claim. If that surgeon 'admitted' to 'negligence/malpractice', and you have witnesses, you've got the start of a good case. However, he may have said something like, we tested it and it was ok, even though we thought it needed to come out. In order to actually determine if you have a case, you must have another doctor willing to testify that there was malpractice, unless the surgeon admits to it. That is unlikely. It may have been a reasonable diagnosis at the time. If another doctor says it was unnecessary and doing such was below the standard of care that the community of doctors would have given, then you may have a viable case. Contact me directly.
