When a professional fails to disclose important information they may have extended your right to bring a claim.

If your damages are significant you should see an attorney promptly.

Re: what are my rights

Theoretically, yes. You can sue anybody at anytime. If he had malpractice coverage at the time of the surgery and you prevail on a malpractice claim, then you can look to the insurance coverage for satisfaction of a judgment.

Malpractice cases are very fact-intensive. Have a medical malpractice attorney in your area review your records immediately, since time limits apply to your situation. Good luck!

Re: what are my rights

Suit is possible, with or without insurance or license, and the hospital will be worse off if they let me work without license. Before being allowed to file suit, you must have another doctor's opinion that he committed negligence that harmed you. We can help you find doctors to consult if you don't have such opinion already. Feel free to contact me to discuss your facts, rights and remedies. Don't delay, there are time limits.
