Legal Question in Medical Malpractice in California
scars on leg from improper saw use during cast removal
My son (now age 5) had cast for
broken leg at age 1.5. In the
hospital after cast was placed he had
the cast cut because it was too tight
causing vascular compromise. The
2nd year resident orthopedic surgeon
cut a few inches of the cast. My son
was screaming and we thought he
was in pain. The resident said the
saw doesn't cut skin. Eight weeks
later when the cast was removed he
had scars on his leg where the saw
cuts were. We thought they might
fade but they have not. Do we have
a course of action for this and what
are the odds we would prevail?

Possibly.
Find a specialist in medical malpractice, and ask him/her to review the matter. These are not easy cases to win, and require lots of investigation.

You may have a cause of action, but in my view, the costs are not worth the potential recovery.
