Legal Question in Medical Malpractice in California
I need to know what type of attorney to get for my sister.
A short story of what happened to her.
My sister & her partner both had the same phychiatrist. This doctor was always increasing the medication dossage to the maximum for my sister. At one of her sessions this doctor made a pass at her & she pushed him away & nothing more was said. At the next session he kissed her & this led to sexual contact. The drugs he was giving her had bad side effects but he continued to increase & add more drugs. He had her convinced that this sexual contact would help her because he loved her. Mean while he continued to see her partner of 20 years. She was seeing this doctor for a long time. He knew her weakness & insecurities. A few months ago he had to put her out of work on dissability (she is a teacher). Next she got a call from Kaiser that he suddenly retired. She is now a tottal wreck & we had to make an emergency appointment for her with a new doctor.
I feel that this is out-right sexual & mental abuse & medical malpractice.
The fact that he suddenly retired leaves me to believe that he may have been asked to because there are others like my sister.
In 2009 a complaint was filled with kaiser that he was over medicating a patient.
I hope you can tell me where to go for help. I want this preditor stopped!!!!!

Too bad your sister had Kaiser, because she has to go to Arbitration instead of being allowed to sue. She (or her partner or both) should see a lawyer.
Yes, it looks like professional misconduct and sexual abuse. His 'sudden' retirement is probably related to him doing the same thing to others, and he got disciplined. That would add credibility to your sister's allegations. Your sister can file a complaint with the state licensing agency, and can pursue legal action against him if she can corroborate her allegations with some evidence. If this occurred within the last year, and if this is in SoCal area, and if she is serious about pursuing it, have her contact me.
