You can't file suit without obtaining that opinion. Even if it was actual negligence, unless you have substantial physical damages, harm and medical expenses, it's not likely worth pursuing. You said nothing about that. Medical malpractice claims are vigorously opposed, typically with 'scorched earth' defense. They seldom settle. So, don't get your hopes up unless you have a great 'slam dunk' case.
