Legal Question in Personal Injury in California

assaulted in a bar

I was a patron at a local bar, I was assaulted by an unknown customer at the bar, the bar gave me towels to clean me up and drove me to the hospital. Are they responsible for providing a safe environment for their customers? Are they libel for that other bar patron's actions? I only want the bar to pay for my medical expenses, do I have any chance of getting them to agree to that without going to court?

The bar has a duty to act reasonably. If the guy was obviously drunk and they continued to serve him, they may be liable. If the guy was obviously violent and looking for a fight and they failed to throw him out, they may be liable. However, under normal circumstances, no one is bound to anticipate and/or guard against the negligent or intentionally tortious conduct of another. Translation = it's probably not the fault of the bar that this guy roughed you up.

It wouldn't hurt to send them a friendly letter with a copy of your medical bill, and ask them in a nice way if they would consider paying for your medical bills in line with what the other attorneys say. By doing so, you're being very reasonable by not asking for compensation for your pain and suffering.
