Legal Question in Personal Injury in California

Auto accident statute for filing

On June 28th 2003, while driving her car, my wife was hit by another car. Their insurance company admitted responsibility said they would pay for medical bills. Today their Insurance company asked for 2 more weeks to pay. This goes well beyond the one year we thought we needed to file should they fail to pay. They claim Statute has been changed to 2 years. Is this true?

Yes, the statute of limitation for personal injury is now two years. Without a lawyer, your wife probably won't receive or will receive inadequate compensation for her pain and suffering. You might talk to a lawyer about that. I hope she's healed by now.

Yes it is true. However, they will try to say thatyou over treated, were overcharged etc and they will offer only a fraction of the amount. You need to get an attorney ASAP.

Yes. But why would you want to settle for an amount that does not compensate her for her pain and suffering and other damages?
