Legal Question in Personal Injury in California
Beatup by Boss
My former roommate and I work at the same company, driving trucks.Except for now we dont see eye to eye on anything due to him moving out in the middle of the night leaving me with his unpaid bills. He is now the dispatcher for the Co. so therefore he is my boss. To make a long story short he managed to get me fired inwhich this was on a Sunday and the following Monday the owner of the Co. came to my house, said nothing, then blind sided me. Knocking me to the ground, repeating the abuse about six or seven times, when I would try to get up blam he'd hit me in the head again and again till I ended up in the hospital, with black eyes, concussion, and a $2500.00 dollar bill. Then about a week later I get a visit from a couple of thugs telling me to drop the charges or else. Fearing for my life I dropped the charges. What are my options????

If you are unwilling to be the complaining witness in a criminal case, there's little that can be done. You also have a civil claim for battery. Again, though, you must be a willing participant in a lawsuit.

If you are easily intimidated by thugs, get an ice pack. Otherwise I would start by going back to the police, followed by a call to a lawyer.

You can get a court order (protective order) which will allow you to obtain police intervention if those threatening you violate the order. Also you can sue for assault and battery and get a judgment for damages from the thugs that beat you up. However these are not without risk. You need to decide how much risk you are willing to tolerate so as not to be made a victim by your own fear.
