What happens if you borrowed a car and someone hits you? What about if you didn

I was involved in an accident. A women backed out of her driveway into me as I was driving down the road. She ran straight into the passenger side of the car I was driving. My car was in the shop, so I borrowed a friends to run an errand. When I told the friend, she told me her insurance had lasped and she had not had the money to start it up again and thus had not been driving.....Where does that leave me? I do not have insurance on any other car. This is my first accident and I feel as though I was not at fault at all, but it seems like my rights are really limited.

These days, when you borrow another car, you have to ask if there's ins on it. If your friend had no ins, yours would step in. With you having nothing, you're an uninsured motorist and there could be a potential problem with your license later on. The person backing out would be responsible to your friend for the property damage and to you for medical bills. But Calif. law says either the driver or the vehicle must have liability ins on it. Your car insurance should cover you while driving a loaner. The accident should be covered by the other party's insurance anyway. Make a demand on the other party's insurace before having your's pay.
