Legal Question in Personal Injury in California
I broke a tooth while eating a broccoli at a brand-named restaurant in California. The management were aware and told me their insurance will take care of it. Now the insurance is saying since there is no physical evidence of the object (it was swallowed), they are not able to compensate us for the tooth because they do not have medical on their liability insurance. I was just asking for them to cover the dental fee. Can I sue the restaurant to receive compensation for this? Thank you.

You can sue for anything you want. The question is can you prove there was some foreign object in the food that broke your tooth. If you can't, you will lose the case.
