My brother is mentally disable, he's 21 years old, and someone has broken him and he cant sue because he is scared of being deported. How can i sue on his behave.

The general rule is you cant sue on behalf or assert the legal rights of someone else. You mentioned that he is mentally disabled. You may be able to sue on his behalf if he cannot handle his own affairs due to his mental disability. You should look into setting up a conservatorship.
