Car Accident and little insurance

Help,

I was in a car accident July 21, 2002. Should I settle and only bring home around $13,000 after all fees? I am disabled/nerve damage in foot 15 pills a day to walk, lost over $30,000 in earnings, still losing earnings. It was the other drivers fault, his ins. $25,000/$50,000 my uninsured $30,000/$60,000. He owns a home in Hacienda Heights, CA has $75,000 homstead and my advice has been to settle because he may file bankruptcy. Help

It is rarely worthwhile to sue another driver unless he is very well off or you want to invest $4-500 on an asset investigation. Probably take the $25K, then get an additional $5000 from your own underinsured motorist coverage. And then, raise your UM/UIM coverage to $100,000 per person.

You have very little time to do anything but file a lawsuit if you're not prepared to accept their current offer. Obtaining an attorney and filing a lawsuit will certainly put pressure on them to increase the offer, or face a larger judgment at trial plus their expenses to litigate the matter.

How frustrating. I assume you have an attorney thus far. But, for what it is worth, I would not recommend settling with his insurance in satisfaction of your claim against the other driver.
