Legal Question in Personal Injury in California
Car Insurance
My husband who is a car salesman was in his company car with potential buyers when he was rear ended by a unlicensed driver. The lawyer for the buyers is demanding our personal auto insurance information. They already have the dealer ins. Do we have to give it to them?

Re: Car Insurance
I don't think you should give it to them. Your husband must be covered by his company's insurance. This should be enough. If this wasn't a major collision causing very serious injuries, then the company coverage should be enough. If not, I would be curious to know why the lawyer wants that information.

Re: Car Insurance
I think Mr.Itkin is correct. There is no reason to have your personal information.
I would refuse, also.
Re: Car Insurance
Under vehicle code section 16005, anyone who suffers injury in an accident is entitled to insurance information. They may obtain the information from the DMV. Under VC Section 16025, a driver, police officer or property owner in an accident is entitled to such information from the other drivers involved in the accident. So, it appears that the passenger is not entitled to the information directly from your husband, although he may get it from the DMV or another driver.

Yes.

I answered, "yes", perhaps too fast. You dont' have to give it to them, but why not?
