Legal Question in Personal Injury in California

I was side swiped on the freeway byhit and run drunk driver

and was just told that his insurance policy just exspired,

and im behind on payments due to no transportation ,truck in repair shop but on hold due payment ! i have insurance but i have to pay a 500 deductable ,but not working nor have any means of transportation and about to loose truck if i don't make a payment! The finance company won't release the check until payment is updated! The kid was 19 ,driving a work truck! who and what is responsible for this inconveince and mishap that is about to take it all away!Can't i get a rent a car! Somebody needs to pay not me!

IF the guy has no insurance, any recovery you want has to come from him. If he has no wealth, assets, income, etc., you are facing minimal or no recovery. You can sue him and get a judgment, but collection is your problem. If it was a vehicle belonging to some company, you can also make a claim against them and sue if necessary. IF you have uninsured motorist insurance, make your claim, and get the best deal you can from them. Your policy determines if you get rental car.
