Legal Question in Personal Injury in California

civil judgement against me by dmv

I was a registered owner in an auto accident, but not the driver, the car was not insured at the time of the accident. i now have a judgement against me. my license was suspended. i am on disability due to a recent diagnosis of breast cancer. what can i do to clear this, i have no money to pay this $5,000 debt, but need to get to my chemo treatments and also drive to work after my treatments are completed. the person who was the driver was also sued, but he filed bankrupcy. is there some kind of release form i can fill out and ask the attorney for the person who has sued me to clear this judgement from my record. should i consult an attorney

You should consult with an attorney that has experience in the area of bankruptcy law. I have not researched this issue for many years but as I recall filing bankruptcy and discharging the debt would allow you to get your license. You should move quickly as the bankruptcy law is set to change soon. The reports are that this will make major changes in the law and your benefits.

Sorry, but the only way you are likely to get it 'cleared' is by paying it. Try to offer them a compromise, reduced amount in payment. Then, you can try to get DMV to release your license. You could possibly file a bankruptcy to discharge the debt, if you qualify, but that won't get your license back.
