Legal Question in Personal Injury in California

My daughter was in a car accident in 2007 where she was driving straight through an intersection on a green light. a car made a left turn and hit her. As stated in the police report, she was not speeding or anything, yet our insurance company said that she (my daughter) was at fault. At the time, I was going through a chaotic divorce and didnt think to dispute the insurance company on this matter. What is the statue of limitation to take action to get the insurance company to pay for the damages to the car? It was totaled and I think if it was NOT her fault, the ins co should have stated it as such.
