defendant in auto personal injury and property damange
I rear ended another vehicle in June 2002. At that time there was no personal injury to the person that I could tell and her car did not have a scratch. Just today, 1/9/05, I received a court summons for a limited civil case that does not exceed $10,000. I am seeking advice and possibly representation. Is there not a statute of limitations.. that a person has to file suit within a certain time after the accident.. it has been more than two years now. I had not heard anything about it until now.

The statute of limitations for personal injury cases is 2 years from the date of accident. For property damage, it is 3 years from the date of accident. Check the date that it was filed. You may need to contact an attorney to properly respond.

If you were covered by insurance, immediately contact you insurance company and report the law suit. They should file a response to the complaint.

If you had insurance at the time of the above accident (even if you are now NOT insured by that compay), refer the summons and complaint to that company.
