Legal Question in Personal Injury in California

How to determine monetary damages for hearing damage

I was hit by an airbag in an auto accident, and as a result, I suffer from a constantly-popping eardrum and a tinny sound when listening to certain higher frequency sounds. After some consultation and 18 months of ''time to heal'', There is no clear remedy for this. I am interested to find out what I should ask for in an insuramnce settlement. My medical expenses have amounted to roughly $4,000 so far, and I have been offered $13,000, which would cover the medical, a few days lost wages, and the ''making me whole'' part. I am interested to know if this offer is at all in line with conventional settlements of this type.

Thank you very much for your help!

Do you have an attorney now? Let me know if you want me to look up jury awards and/or negotiate.

Re: How to determine monetary damages for hearing damage

Normally, damages are in the general area of 2 to 10 times medical expenses and lost wages.

You also have to anticipate future medical care.

It sounds like you have been attempting this on your own, which is seldom the best way to go. I would run, not walk, to a personal injury attorney.

You have been offered an amount that is quite low, and whatever you do, do not take any money and sign a release.

Good luck!
