What are the consequences of a hit and run accident if the person was

drinking and fled the scene of tha accident?

Sue them.

Get a list of all of their offences including the one against you -- I would do it. Seek you civil claim via restitution against them for your damages -- contact me and I will investigate the case.

The answer to your question will depend on various factors that you have failed to mention. Some of the missing information is:

1. What was the injury caused to the other driver/passenger, if any?

2. What was the DUI driver's blood alcohol level?

3. Was it a first DUI offense?

4. How far did the DUI driver go (ie: it is a lot less severe if he drove 2 blocks and then stopped vs. getting chased down)

The above questions and many others would need to be answered before someone could give you an intelligent answer.
