Legal Question in Personal Injury in California
is homeowners INSURANCE responsible for accident in garage
my son cut off the tip of his finger off on a goped while he was at my parents house in their garage. do I have a claim for thei homeowners insurance to reconstruct the tip of his finger and fingernail. He has had medical attention only at the emergency room of the hospital, but the finger is giving him pain and is constantly sore and numb. The e.r. dr's said their was a strong possibility of a reconstructive type of surgery and therapy to regain full sensations in the finger. and are they liable for pain and suffering?

There is further information one would need: where did he live, how did it happen, etc. If there is a "medical payments" portion of the policy, that would cover medical bills, regardless of fault, up to the amount of the coverage.

It is possible that your parents' homeowners' insurance policy will cover for liability as well as "medical payments". Much will depend upon where your son lives, what the action was in the garage and other factors. Consult an attorney before dealing with the insurance company. Homeowners' policies generally exclude injuries involving motorized vehicles.

If willing to sue your parents, make a written claim on them to trigger their homeowners insurance coverage and follow up with suit if not settled. If you need an attorney, contact me.

Thank you for your posting.
An insurance policy is a written contract, and contains the coverages and exclusions under a particular policy. You may want to look at the insurance policy and exclusions first, but if there is a medical provision, as mentioned here, there may be coverage.

File the claim against the insurance co. Have your parents notify the company.
