Legal Question in Personal Injury in California

injured-inmate

A friend of mine who is in custody in sacramento county, recently slipped in the shower and broke her ankel. She has been given little medical care, and needless to say,is in a lot of pain.Unfortunatly she wont be released until December (2005). My question is, can she sue sac. county for pain and suffering, or get ANY legal compensation? If so, what information can I give her to do so? Thank You

Re: injured-inmate

The short answer is yes. Let her know she has six months from the time of the injury to file a claim with the public entity directly. As to torts against government entities, you have to file a claim with them first, and then they have a certain amount of time to respond, etc., and then you have 6 months from the time they reject the claim (or more time if they never formally rejected it and their time to respond passes by operation of law) to file a lawsuit. Have her check out California Government Code Section 900 et. seq.; which explains the entire process.
