Legal Question in Personal Injury in California
Injury Accident DUI, Broke Back, Booked and No Medical Attention
Back 2005 I made the worst mistake of my life and on July 4th, had too much to drink and my designated driver for the night ended up dropping me off at my car. I ended up driving, it was late at night and I fell asleep at the wheel. I rolled my truck and was found by the police. I dont remember anything that happened as I had too much to drink and had a bad concussion, which erased all the events leading up to the accident. When I finally started knowing what was going on, I was in jail, with a hole in my tounge, a chipped tooth, and my back was in severe pain and I could feel the bones in my back just weren't right.
I repeatedly asked for medical attention, but was told if I needed medical attention I needed to post bail. After several hours of pain and misery I was finally released after posting bail.
I went directly to the hospital and was told my back was broken in two places, and should try not to move. I was treated and put in a back brace.
4 years later my back still hurts to this day. I often wonder why I was never taken to the hospital after my accident and why I was denied medical treatment. I believe that if I was treated right, my back wouldn't be as bad as it is today.
Should/Can i seek a civil suit?

-I- often wonder why people sit around wondering for 4 years instead of filing a lawsuit within the legal time limit, which you didn't do.

The statute of limitations against any government entity is 6 months from the date of the injury. You have blown the statute of limitations deadline and do not have the right to sue anymore.

Not 2 to 3 years after the Statute of Limitations expired.
