liability for dob injuring delivery boy

my dob attacked a delivery boy. I paid his copay to emergency room and just received a letter telling me I must pay all of the bill. Am I or am I not liable for this?

You are generally liable if your dog bites someone. You can read about this at my blog, www.calpiblog.com.

If you are going to pay the bills, make sure you get a signed release from the other guy. If you do not, he can come back at you for more money.

Unless there are some unusual facts you haven't mentioned, you are liable. The fact that insurance paid the bill doesn't matter, since the insurer can sue you in order to recover the money it paid out. (Technically the delivery boy will be the plaintiff, but the insurer will be the one entitled to the money. Most insurance policies require the insured to act as plaintiff in such lawsuits.)

Of course you are liable for all injuries and damages caused by your dog. He doesn't have to use his insurance to pay those bills. If you are lucky, he won't sue you for general damages, if you pay all his bills.
