Motor Cycle Accident

My Daughter has been in a motor cycle accident and the driver did not have insurance. how do I RECOVER MEDICAL EXPENCES

If your daughter has her own vehicle with Med Pay or UM coverage, she could get coverage there. If she lives at home with you and you have those coverages on your policy, that would be an option, too.

If she had an uninsured motorist coverage and/or medical payments coverage on her own policy, that should cover her.

You probably don't. Unless the driver and/or registered owner actually has substantial assets and income, there's little point going after them; they could just file bankruptcy after you've spent time and money suing them. If the driver was a minor, check his parents too, they are liable up to $15k each, if they have anything to collect against.

If they all have nothing, that's what you'll get.

Make a claim on your own Uninsured Motorist coverage, if you have any.

Next time learn from this lesson: have high limit PL/PD and med pay coverage on your insurance and max limits on your Uninsured Motorist coverage - it's what will pay your medicals if the other guy doesn't have insurance. The CHP estimates 1/4 to 1/3 of the cars on the road don't have insurance. You've been warned.
