if a person has passed on while being under investigation for child molestation can the suspects estate be sued?

Yes, but there are strict time limits on filing a lawsuit against a decedent's estate. If such a lawsuit should occur, the administrator or heirs should consult with an attorney.

In California - Yes. CCP Section 377.20, 377.40 - 377.43.

Yes. Also, keep in mind Plaintiff needs to prove by the prepoderance of the evidence that he or she was molested and harmed.
