Legal Question in Personal Injury in California

Release of Liability

I have heard that a Release of Liability will not hold up in California Court, that you cannot release someone from their responsibility if their actions cause damage to property of person. Is this true?

No. Under most situations, a properly written release will be upheld as to negligent actions but not intentional ones. This rule is not universal, and there are many reasons why the result might be different in a given case.

BS. That is exactly what releases are for. It is difficult to overcome a release unless you can prove gross negligence, misconduct, criminal behavior.
