Legal Question in Personal Injury in California
Once settlement check is signed
My attorney had me come in and I signed a check and he put in his own account. I have came from out of town where my mother is ill and need to get back. If he is able to put the check into his account can he write my check so I can go home?

It depends on how much your check is and does he already have money in his trust account to cover your check. Many times we have to wait a few days for the check to clear before we can write checks to our clients. You would have to ask him these questions to see what he can do.

Once the settlement check 'clears' the bank, sure. Large checks may take 10 or more days to clear.
