Re: Statute of limitations
One year.
The statute of limitations has been changed as of this year to two years from the date of the accident... and, there is some dispute as to whether the new law is "retroactive" or applying to cases before 1/1/03.
The new law sets out a particular exception of retroactivity for 9/11/01 claims. Because of this specified limitation, I would say that all accidents occurring before 1/1/03 are subject to the one-year statute.
File by 3/7/03... good luck.
Re: Statute of limitations
1 year for from the date of the accident for personal injuries and 3 years for property damage.
Re: Statute of limitations
Probably one year, maybe two, but don't bet your case on it. Contact me if interested in pursuing, you have to file suit by that date, so don't wait.
Re: Statute of limitations
Thank you for your posting.
Under a new law passed 1/1/03, you have two years to file a claim, but except for special circumstances, this law only applies to matters where the injury was after 1/1/03.
In your case, you should file BEFORE 3/7/03, and the earlier the better.

Re: Statute of limitations
Prior to 1/1/03, the statute was one year. On 1/1/03, it was changed to 2 years. Question as to retroactivity. Be safe and file befor 3/7/03
