Legal Question in Personal Injury in California

I want to sue a cop for false arrest and ruining my life.

In november 2006 I was arrested and bothered by an officer who was mistaken about a crime that had not been committed.

He checked out a van my friend had left parked in front of my motel room on private property without complaint, he profiled the van for its age and thought it had stolen tags on it. It did not have stolen tags on it just expired ones. The van was not mine nor had I ever driven it, case was dismissed in court the next day. Mean while my baby was with me when this cop should never have bothered me.

Cps took my baby and horribly abused my sweet girl for over a year while I jumped through every hoop they threw at me.

How can I sue this jerk for making me go through hell costing me thousands and my child was abused in foster care which I have alot of evidence to prove this.

I am in santa clara county california

"How can I sue...?" You can't. The time is long passed for timely filing your claim. Plus, agents and agencies have 'immunity' from suit unless you can show it was willful intentional misconduct beyond the scope of their authority, which you can't do in these circumstances. Put it behind you and move on.
